Terms of Service

Modebase is operated by Nerida Wendy Lindsay, a sole trader trading as “Modebase” (ABN 11 593 506 649) (“we”, “us”), based in New South Wales, Australia. Contact: support@modebase.co.
By creating an account or using Modebase, you agree to these terms and to our Privacy Policy.
1. What Modebase is
Modebase is a wardrobe infrastructure layer: you photograph your clothes, and we help you catalogue them as structured data your own AI assistant can read and write, generate catalogue-style images (“renders”), build outfits and edits, and share lookbooks. Some features use artificial intelligence and produce generated images and extracted details.
2. Your account
- Modebase is for adults. You must be 18 or older to create an account or use Modebase.
- Keep your sign-in email secure; you are responsible for activity on your account.
- One account per person; accounts are for personal, non-commercial use.
3. Your content and your licence to us
- You own your content. Photos (including any selfies or worn shots you send) and details you add remain yours.
- Licence: so we can run the service, you grant us a non-exclusive, worldwide licence to host, store, reproduce, process, adapt (for example generating cut-outs and renders), and display your content, including passing it to the service providers named in our Privacy Policy for processing. This licence exists only to provide and improve the service, lasts while your content is on Modebase, and ends when you delete the content or your account (except for short-lived backups as described in the Privacy Policy).
- Generated images: to the extent we hold any rights in renders and other outputs generated from your content, we assign or license them to you for your personal use. You are responsible for how you use generated images.
- Sharing: if you create a shared link — a lookbook or a shared outfit — you are choosing to make that content viewable by anyone with the link until you revoke it.
4. Acceptable use
You agree not to:
- upload content you do not have the right to use, or content depicting anyone other than yourself without their consent (including selfies of other people);
- upload unlawful, sexually explicit, hateful, or harassing content, or content involving anyone under 18;
- use Modebase to harass, impersonate, or harm others;
- attempt to bypass usage limits, probe, scrape, reverse engineer, or disrupt the service, or use it to build a competing dataset;
- resell or commercially exploit the service without our written agreement.
We may remove content or suspend accounts that break these rules. Anyone can report a shared lookbook via the report link on its page.
5. Payments, packs, and refunds
- Modebase is free to use, and includes a set number of AI item renders to start (currently 10). Current limits are shown in the app and may change. There is no subscription.
- Render packs. To create more catalogue renders you buy one-time render packs, billed through our payment processor, Stripe, at the price shown in the app at the time of purchase (in Australian dollars). Packs add renders to your balance and never expire (currently from A$9.99 for 20 renders up to A$69.99 for 200 renders). They are one-off purchases, not subscriptions, and are drawn down as you render items. We are not currently registered for GST, so no GST is charged; if that changes, prices will be shown inclusive of GST.
- The Wardrobe Audit. A one-off product (currently A$39) that provides a guided read of your wardrobe. It is a one-time purchase, not a subscription. What it includes is shown at the time of purchase and may change.
- Refunds. A purchase (a render pack or the Wardrobe Audit) is refundable on request within ten days, no questions asked, to the extent the renders in a pack have not been used. After that, purchases are generally non-refundable except where a refund is required by law. To request one, email support@modebase.co.
- Changes. We may change prices or what a purchase includes with reasonable notice; any change applies to future purchases, never to renders you have already bought.
- AI features consume third-party compute; we may apply fair-use and rate limits to keep the service available for everyone, and may pause AI features temporarily to protect the service.
- Your consumer rights. Nothing in these terms excludes, restricts, or modifies any right or remedy you have under the Australian Consumer Law or other laws that cannot lawfully be excluded.
6. AI-generated content: what to expect
Renders, detected details, and extracted information are generated by AI and can be inaccurate, incomplete, or visually imperfect (for example, a render may not exactly match a garment’s true colour, cut, or fit). Do not rely on generated images or extracted details for purchasing, sizing, resale descriptions, or any decision where accuracy matters; check the original item.
7. The service may change
Modebase is an evolving product. Features may change, be added, or be removed, and the service may be unavailable at times. We will not remove your stored content as part of ordinary feature changes, and if we ever discontinue Modebase we will give reasonable notice and an opportunity to export or retrieve your content.
8. Australian Consumer Law
Nothing in these terms excludes, restricts, or modifies any consumer guarantees, rights, or remedies you have under the Australian Consumer Law or other laws that cannot lawfully be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
9. Disclaimers
Subject to section 8, the service is provided “as is” and “as available”, and we do not warrant that it will be uninterrupted, error-free, or that generated content will meet your expectations.
10. Liability
Subject to section 8, and to the maximum extent permitted by law:
- we are not liable for indirect or consequential loss, loss of data caused by events outside our reasonable control, or losses arising from your breach of these terms; and
- our total liability arising out of or in connection with the service is limited to the greater of (a) the amounts you paid us in the 12 months before the event giving rise to the claim, and (b) A$50.
Where liability cannot be excluded but can be limited, our liability is limited to re-supplying the service or paying the cost of re-supply.
11. Indemnity
You are responsible for the content you upload and share. You agree to indemnify us against claims by third parties arising from content you upload in breach of section 4 (for example, photos of other people uploaded without their consent), except to the extent we caused the loss.
12. Ending things
- You can delete your account at any time in the app; this permanently deletes your content as described in the Privacy Policy.
- We may suspend or terminate accounts that seriously or repeatedly breach these terms, with notice where reasonable. If we terminate without cause, we will give you reasonable opportunity to retrieve your content.
- Inactivity. If your account is inactive for 24 consecutive months, we may close it to free up storage. Before we do, we will email the address on your account and give you at least 30 days to sign in or export your content; if we hear nothing, we may then delete your content and close the account. Any unused render-pack balance is forfeited when an account is closed for inactivity.
13. Changes to these terms
We may update these terms as the product evolves. For material changes we will notify you in the app or by email before they take effect; continued use after the effective date is acceptance.
14. General
These terms are governed by the laws of New South Wales, Australia, and the courts of that state have jurisdiction. If any part of these terms is unenforceable, the rest remains in effect. These terms and the Privacy Policy are the whole agreement between us about the service.
